MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Tuesday 20 March 2012 from 2:00 pm to 2:15 pm.

Present: Councillor Lesley Ingham (Chairman), Councillors June Garrad and Tony Winckless.

Officers Present: Ian Mackenzie, Kellie Mackenzie, Brian Planner and Donna Price.

Also In Attendance: Mr Christopher Connelly.

The Chairman opened the meeting by introducing the Sub-Committee and the Officers present. She then outlined the procedure that would be followed.

review of a hackney carriage driver's licence

The Chairman introduced the report which provided details of a hackney carriage driver's penalty point record. She explained that Mr Christopher Connelly had accrued 16 penalty points within 13 months for offences which were outlined in the report.

Mr Connelly apologised for breaching the licensing conditions but advised that he had been under a lot of stress recently in his personal life. In response to a query from a Member, Mr Connelly advised that he had not been able to display his badge as his badge holder had broken, this was now repaired. Mr Connelly agreed to ensure that a copy of the licensing conditions was in his cab at all times.

The Licensing Sub-Committee adjourned to make their decision at 2:06 pm. Members of the Sub-Committee, the Assistant Solicitor and Democratic Services Officer returned at 2:10 pm.

The Chairman advised that Mr Connelly's Hackney Carriage Driver's Licence would be suspended for two weeks, commencing on 10 April 2012. She advised Mr Connelly that he had 21 days from the date of the decision to appeal.

RESOLVED:

(1) That Mr Christopher Connelly's Hackney Carriage Driver's Licence be suspended for two weeks from the 10 April 2012.

review of a hackney carriage driver's licence

The Chairman introduced the report which provided details of a hackney carriage drivers penalty point record. She explained that Mr Duncan Braithwaite had accrued 18 penalty points within 13 months for offences which were outlined in the report.

The Head of Service Delivery advised that Mr Braithwaite was not able to attend the meeting.

Members raised concern about the number of points Mr Braithwaite had accrued within a short period of time and the points accrued for smoking in the vehicle was of particular concern. Discussions ensued and Members agreed to suspend Mr Braithwaite's Hackney Carriage Driver's Licence for three weeks, commencing on 10 April 2012.

RESOLVED:

(1) That Mr Duncan Braithwaite's Hackney Carriage Driver's Licence be suspended for three weeks, commencing 10 April 2012.
