MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Tuesday 16th March 2010 from 7:00 pm to 7:08 pm.
Present: Councillor John Morris (Chairman, Councillor Lesley Ingham (Vice-Chairman), Councillors Dave Banks, Bobbin, Mick Constable, Harrison, Prescott, Paul Sturdgess and Nick Williams.

re-adoption of the miscellaneous provisions act 1982The Chairman introduced the report which asked Members to recommend to full Council that in light of changes, the Miscellaneous Provisions Act 1982 Schedule 3 as amended by Section 27 of the Policing and Crime Act 2009 be re-adopted. RECOMMENDED:
(1) That in light of legislation changes, the Miscellaneous Provisions Act 1982 Schedule 3 as amended by Section 27 of the Policing and Crime Act 2009 be re-adopted. |

new mandatory drinks code and licensing conditionsThe Chairman introduced the report which advised Members of a new piece of legislation, due to come into affect in April 2010 relating to new mandatory drinks code and licence conditions. RESOLVED:
(1) That the report be noted. |

councillors representations in respect of licence applicationsThe Chairman introduced the report which informed Members of current advice issued by Lacors in respect of elected members making representations under The Licensing Act 2003. RESOLVED:
(1) That the report be noted. |

establishment of a licensing act 2003 committeeThe Chairman introduced the report which explained why the Council's Licensing functions should be administered by two Committees rather than one. RESOLVED:
(1) That the statutory requirement to establish a separate Committee to deal with functions under the Licensing Act 2003 be noted. (2) That Council has to either amend the current terms of reference of the Licensing Committee or create a Licensing Act 2003 Committee. (3) That the proposed terms of reference for the Committee dealing with Licensing Act 2003 functions be noted. |

faversham hop festival, street trader permitsThe Senior Solicitor introduced the report which asked Members to delegate the power to approve Hop Festival Street Trader Licences to an Officer. RESOLVED:
(1) That street trading consents for Faversham Hop Festival be delegated to Officers to approve or refuse. |
