MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Friday 5 October 2012 from 10:00 am to 10:55 am.

Present: Councillor Duncan Dewar-Whalley (Chairman), Councillors Ben Stokes and Tony Winckless.

Officers Present: Kellie Mackenzie, Donna Price and Georgia Shaill.

Also In Attendance: Councillor Andy Booth and Duncan Milne (Investigating Officer).

Councillor Ben Stokes declared an interest as he had known the subject member for some time and he also had been a member of the Planning Committee.

Councillor Tony Winckless declared an interest as he had been a member of Swale Borough Council since 2011.

Councillor Duncan Dewar-Whalley declared an interest as he had known the subject member for some time.

The Assistant Solicitor reported that whilst all Members of the Sub-Committee were acquainted with the subject member due to their role as Councillor's of the same authority, this was not a pecuniary interest and did not preclude them from considering the complaint.

Members agreed that the meeting would be held in open session. The Chairman advised that the matters would be considered together as there was no material differences and he outlined the procedure for the meeting.

The Chairman then invited the Investigator to present the findings of his investigation into the alleged breaches of the Code of Conduct. Members were given the opportunity to ask questions of the Investigator.

The Chairman then invited the subject member to present his case into the alleged breaches of the Code of Conduct. Members were given the opportunity to ask questions of the subject member.

The Sub-Committee, Assistant Solicitor, Democratic Services Officer and Democratic Services Apprentice left the meeting at 10:15 am and returned at 10:52 am to advise of the Sub-Committee's decision.

The Sub-Committee determined that there had been no breach of paragraphs 9 and 12(a) of the Code of Conduct.

In concluding the meeting, the Chairman confirmed that a written decision would be produced and forwarded to both the subject member and complainants. The subject member gave his permission for the notice to be published in a newspaper.

RESOLVED:

(1) That the Sub-Committee found that there was no breach of Paragraph 9 or 12(a) of the Code and therefore no sanction should apply.
RECOMMENDED:
(1) That, to promote high standards of conduct among Members, the Sub-Committee asks that the Monitoring Officer writes to all Members of Swale Borough Council clearly detailing that with regard to declarations they need to seek advice from the Monitoring Officer, the Head of Legal and Democratic Services or from other Solicitors in Legal Services as early as possible, in advance of meetings.
