MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Thursday 27th April 2006 from 10:00 am to 11:00 am.

Present: Councillors Barnicott (Chairman), Dave Banks and Anita Walker.

Officers Present: Miss Hammond, Mrs Potts and Mr Hawkins.

Also In Attendance: Messrs Carey, Sasmaz, Thomas and Turcan.

The Chairman opened the meeting by introducing the Sub-Committee and the Officers present. He explained that the Sub-Committee would consider a re-hearing of an application for a Premises Licence for The Charcoal Grill, High Street, Milton Regis and detailed the procedure that would be followed.

a re-hearing of an application for a premises licence under the licensing act 2003

Mr Thomas, Solicitor for the Applicant, introduced Mr Sasmaz, the Applicant and Mr Carey, a local resident who was in support of the application. Mr Thomas informed the Sub-Committee that the Applicant had decided to amend the hours requested for closure to 24:00 hours Sunday - Wednesday and 02:00 hours Thursday, Friday and Saturday. He explained that the Applicant had not been present at the previous meeting due to a misunderstanding and they had therefore requested an appeal. He emphasised that the premises had not been subject to any complaints and Mr Sasmaz had a good relationship with his neighbours. Mr Thomas presented a petition to the Chairman, which contained signatures in support of the application. He explained that the Applicant would remain sensitive to his neighbours' needs but considered that the premises were a benefit to the community. He suggested conditions regarding the use of CCTV cameras; signage in the car park and on the premises and the clearance of rubbish which emanated from the premises after it had closed. He hoped these conditions would allay residents concerns. Mr Carey confirmed that Mr Sasmaz was courteous and respectful of local residents.

The Objector, Mr Turcan, explained that he had concerns regarding the potential noise disturbance from the premises. He reported that there had been problems previously with people congregating near the premises and was concerned these problems could recur with extended opening hours. He requested that the Sub-Committee keep the hours agreed at the previous meeting.

In response to a question from the Chairman, Mr Turcan confirmed that he had kept records of incidents such as noise disturbance and anti-social behaviour in the past.

The Chairman invited the Applicant and Objector to ask questions.

The Sub-Committee adjourned to make their decision at 10:38 am. Members of the Sub-Committee, the Senior Solicitor and the Democratic Services Officer left the meeting and returned at 10:54 am, when the Sub-Committee reconvened.

RESOLVED:

(1) That in respect of the re-hearing of a Premises Licence (Late Night Refreshments) at The Charcoal Grill, High Street, Milton Regis, the Sub-Committee's decision is attached as Appendix 1:

Late Night Refreshments (for consumption on and off the premises) Monday - Thursday 00:00, Friday and Saturday 01:00 and Sunday 23:30.

Special conditions to include:
Signage for the car park explaining that the car park is for customers' use only and signage at the exit of the premises requesting customers to respect neighbours and leave quietly.
Staff will inspect the outside of the premises on closing and remove any rubbish emanating from the premises.
CCTV to be in operation at all times that the shop is open.
