MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Friday 27th January 2006 from 2:00pm to 2:45pm.

Present: Councillor Adrian Crowther (Chairman), Councillors Harrison and Woodland.

Officers Present: Miss Langfield, Mesdames Baxter-Rose and Potts and Mr Spiers.

Also In Attendance: Mr Turcan.

The Chairman opened the meeting by introducing the Sub-Committee and the Officers present. He explained that the Sub-Committee would consider an application for a new Premises Licence for The Charcoal Grill, High Street, Milton Regis and detailed the procedure that would be followed.

The Chairman explained that usually the Applicant would be invited to present his or her case first, followed by the Objector, but as the Applicant was not in attendance, he asked the Objector to present his case.

The Objector, Mr Turcan, explained that he lived at 113 - 115 High Street, Milton Regis and that he enjoyed good relations with his neighbours at The Charcoal Grill. However, he had objected to the application for longer hours as he foresaw problems if the licensed hours were to be extended. The immediate area had suffered from high incidents of vandalism and other crime and Mr Turcan stated that he believed that if the opening hours were to be extended, incidents of anti-social behaviour would rise. He therefore asked the Sub-Committee to take these views into consideration when making their decision.

The Sub-Committee adjourned to make their decision at 2:23pm. Members of the Sub-Committee, the Assistant Solicitor and the Democratic Services Officer left the meeting and returned at 2:40pm, when the Sub-Committee reconvened. The Chairman reminded those present of the implications of Sections 51-53 of the Act.

RESOLVED:

(1) That in respect of new Premises Licence (Late Night Refreshments) at The Charcoal Grill, High Street, Milton Regis, the Sub-Committee's decision is attached as Appendix 1:

Late Night Refreshments (for consumption on and off the premises) Monday to Sunday 11:00 to 23:30.
