MINUTES of the Meeting held in the Committee Room, Swale House, East Street, Sittingbourne on Tuesday 24th August 2010 from 9:43 am to 10:09 am.

Present: Councillor Mick Constable (Chairman), Councillors Derek Conway and Lesley Ingham.

Officers Present: Kellie Mackenzie, Samantha Potts and Donna Price.

Also In Attendance: Councillor Roger Truelove and Martin Quinlan(Applicant).

The Chairman opened the meeting by introducing the Sub-Committee and the Officers present. He then outlined the procedure that would be followed.

application for a street trading licence (non-festival)

The Chairman introduced the report which provided details of an application received for the sale of hot and cold food from a trailer at various locations in Sittingbourne.

Mr Quinlan the Applicant, advised that he understood that not all sites detailed in the report were suitable, and was therefore only seeking permission for the following sites: rear of the Forum (entrance to the old underground subway) and Eurolink (opposite Prince's depot).

Mr Quinlan presented his case for trading at both sites. He stated that he held a level II qualification in food hygiene and would ensure that both sites were kept clean and tidy.

In response to a query, Mr Quinlan advised that the Eurolink site was on a service road, not part of the main road.

Councillor Roger Truelove the Ward Member spoke in support of the application. He stated that Mr Quinlan had worked very hard to find suitable sites within Sittingbourne. Councillor Truelove considered the hours requested were not extensive.

The Sub-Committee adjourned at 9:55 am to allow clarification of highway concerns from the Police and site ownership details. The Sub-Committee reconvened at 10:05 am.

The Chairman reported that the site at the rear of the Forum was owned by Tesco. He advised Mr Quinlan that he would therefore need to apply to Tesco for permission. In response to a request the Committee agreed that the Licensing Officer would send Mr Quinlan a letter that he could then forward to Tesco, along with his request, advising them that SBC had no objections to the application. The Licensing Officer would also provide Tesco's contact details for Mr Quinlan.

The Chairman advised Mr Quinlan that the Police Licensing Officer would be happy to accompany him to identify further suitable sites.

RESOLVED:

(1) That in respect of the Street Trading Licence (non-festival), the Sub-Committee's decision is attached as Appendix 1:

That pending evidence being provided from Tesco stating that they have given their permission the following is granted:

Rear of the Forum (entrance to the old underground subway) - Tuesday - Saturday - 06:00 - 14:30 hours.
