MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Tuesday 19th July 2011 from 10:00 am to 10:40 am.

Present: Councillor Derek Conway (Chairman), Councillors June Garrad and Prescott.

Officers Present: Philippa Davies, Sharon Honey, Samantha Potts and Donna Price.

Also In Attendance: Mr and Mrs Green (applicants).

The Chairman opened the meeting by introducing the Sub-Committee and the Officers present. He then outlined the procedure that would be followed.

application for a new premises licence under the licensing act 2003 - jittermugs coffee shop, preston street, faversham

The Chairman introduced the report which set out the application for a new premises licence for Jittermugs Coffee Shop, Faversham.

Mr Green, the applicant, gave an overview of his application and explained that his business had developed from selling coffee and retail items to a sit-down coffee shop. He advised that there had been interest from customers for the purchasing of alcoholic drinks on the premises. He considered that the sale of wine and beer would not encourage boisterous behaviour in the coffee shop and that the level of noise was just likely to be the sound of people talking together.

Mr Green acknowledged that there had been concerns regarding noise from nearby residents and advised that he was happy to undertake measures to address the potential increase in noise levels; he had previously addressed refrigeration noise from the shop.

In response to questions, Mr Green outlined the food that was served at the shop and he considered the sale of alcohol would be a natural progression for his business.

The Assistant Environmental Health Officer raised concern with the disruption of evening noise to the residents in the flat above the premises and suggested that the sound insulation was not adequate.

Members of the Sub-Committee adjourned to make their decision at 10:15 am. Members of the Sub-Committee, Assistant Solicitor, Assistant Environmental Health Officer and Democratic Services Officer returned at 10:37 am.

RESOLVED:

(1) In respect of the new premises licence at Jittermugs Coffee Shop, Preston Street, Faversham, the Sub-Committee's decision is attached as Appendix 1:

Sale of alcohol: Monday - Saturday 12:30 - 21:00
Sunday 12:30 - 16:30

Special conditions include:
Alcohol sales to include beer and wine only, no spirits

Sale of alcohol will only be allowed until 18:30hrs Monday - Saturday until such time as adequate sound insulation is provided between the commercial and the residential premises to a standard that is to the satisfaction of the Environmental Protection Team Manager.
