MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Thursday 11th June 2009 from 2:00 pm to 3:01 pm.

Present: Councillors Mike Henderson (Chairman), Harrison and John Morris.

Officers Present: Clare Langfield, Kellie Mackenzie and Cath Wallen.

Also In Attendance: Richard Baker (Licensing Consultant), David Hook (Solicitor for applicant) and Najdat Ram (representative of Motor Fuel Ltd).

The Chairman opened the meeting by introducing the Sub-Committee and the Officers present. He then outlined the procedure that would be followed.

application for a new premises licence under the licensing act 2003 – milton regis service station, corner of st paul’s street and king street, milton regis, sittingbourne, kent

Mr David Hook, Solicitor for the applicant, outlined the application. He explained that his clients, Motor Fuel Ltd (MFL) intended to build a 24 hour service station, with late night refreshment (hot food and drinks) throughout the night, and the sale of alcohol 24 hours per day. Mr Hook advised that MFL had been operating 13 other licensed premises for the last ten years and never received any allegations of under-age sales.

Mr Hook reported that MFL accepted all conditions requested by the Police which they considered both sensible and practicable. Mr Hook drew attention to the two letters of objection received and stated that often the apprehension of such developments was disproportionate to the reality. He noted that in the letter received from Activeplay Nursery they mentioned that their building had been vandalised three times last year. Mr Hook considered the security his client proposed at their premises could help improve security for the whole area. In response to a query from a Member, Mr Hook advised that his client’s would be happy for their CCTV cameras to be linked to Swale Borough Council’s own CCTV unit.

A Member queried the operating hours of the proposed serving hatch. Mr Hook advised that it would only be used between the hours of 2300 hours to 0500-0600 hours and confirmed that the site would be manned during trading hours, the hatch would only be used when the front office was closed.

Discussions ensued in relation to the training of staff to ensure alcohol was not sold to underage persons. Mr Richard Baker (Licensing Consultant) explained that within their training manual their was a written test that all staff needed to gain a 100 per cent pass and there would also be signage throughout the store and till prompts. Mr Hook advised that it was the ethos of his clients’ company to ensure staff were suitably trained.

The Licensing Sub-Committee adjourned to make their decision at 2:35 pm. Members of the Sub-Committee, the Senior Assistant Solicitor and Democratic Services Officer left the meeting and returned at 3:00 pm, when the Sub-Committee re-convened.

RESOLVED:

(1) In respect of the New Premises Licence at Milton Regis Service Station, Corner of St Paul’s Street and King Street, Milton Regis, Sittingbourne the Sub-Committee’s decision is attached as Appendix 1:

The Chairman advised that Members had not been convinced of the need for a 24 hour licence for the following reason:

(1) We are mindful of a potential detriment to local residents in terms of public nuisance, and are not convinced the site at this stage should have a 24 hour licence and so at present grant a licence restricting opening hours to 0600 hours to 2300 hours.

Special conditions include:
(i) A digital CCTV system will be installed and maintained fit for purpose (complying with CCTV code of practice issued by the information commissioners office – revised edition 2008). The siting of cameras to be agreed with the Police upon initial installation and from time to time subject to Data Protection legislation.
(ii) CCTV recordings will be stored for 31 days and made available to the Police on reasonable request (no later than 48 hours after initial request). The recordings will be marked with date and time and will record during all business hours.
(iii) A refusal book will be maintained and operated at the premises. The details recorded will include date and time of incident, the name of the staff member serving, the reason for the refused sale, details of the aged related product that was not sold, a description of the person attempting the purchase and any appropriate comments on their subsequent actions.
(iv) Appropriately worded notices will be displayed at all exits requesting customers leave the premises quietly. Appropriate notices regarding Challenge 21 will be displayed near to the counter and alcohol displays.
(v) The Challenge 21 scheme shall be adopted. All staff will be trained to ask unknown customers who wish to purchase alcohol for consumption off the premises and who appear to be under 21 for evidence of their age. The only identification accepted will be a photo driving license, a passport, or any PASS accredited identification.
(vi) All staff will be satisfactorily trained in Challenge 21 and in the sale of alcohol with written records available for inspection upon reasonable request by the Police and other appropriate responsible authority.
(vii) Discuss the potential of linking the CCTV at the premises to the CCTV unit at Swale Borough Council.
