MINUTES of the Meeting held in the Committee Room, Swale House, East Street, Sittingbourne on Friday 9th March 2007 from 2:00 pm to 3:10 pm.

Present: Councillor Alan Willicombe (Chairman), Councillors Barnicott and John Wright.

Officers Present: Misses Davies and Langfield, Mrs Potts and Mr Hawkins.

Also In Attendance: Mrs Thompson and Messrs Frew, Gaunt, James, Cackett, Malyian, Stock and Tinsley.

The Chairman opened the meeting by introducing the Sub-Committee and the Officers present. He explained that the Sub-Committee would consider two applications to vary Premises' Licences, firstly for The Vineyard, 6 - 10 West Street, Sittingbourne and secondly for Sheerness Working Men's Club, 47 Queenborough Road, Halfway, Sheerness. The application to consider an objection to a Temporary Events Notice at Cleve Farm, Cleve Hill Lane, Graveney, near Faversham had been withdrawn and attention was drawn to the tabled paper on this matter. The Chairman detailed the procedure that would be followed.

Mr Gaunt, representing the Applicant, presented his case. He explained that following complaints that had been received regarding fumes from the premises and then discussions with Swale Borough Council's Environmental Health Officer, a scheme of works had been produced and the work would be carried out shortly.

In response to questions, Mr Gaunt explained that the planning permission for the extension of hours was a separate issue, that no food was to be served after 11 pm until the problem of noxious fumes had been rectified and that door staff would be employed to operate on those days where there was in increase in opening hours.

The objector, Mr James, raised concerns that the required work, with regard to rectifying the noxious fumes problem, would not be completed.

The Licensing Sub-Committee adjourned to make their decision at 2:20 pm. Members of the Sub-Committee, the Senior Solicitor and the Democratic Services Officer left the meeting and returned at 2:30 pm, when the Sub-Committee re-convened.

RESOLVED:

(1) That in respect of the application to vary the Premises Licence at The Vineyard, 6 - 10 West Street, Sittingbourne, the Sub-Committee's decision is attached as Appendix 1:
Sale of Alcohol: Thursday - Saturday 11.00 - 01.00
Recorded Music and Dancing: Thursday - Saturday 11.00 - 01.30
Late Night Refreshments: Thursday - Saturday 11.00 - 01.30
Opening Hours: Thursday - Saturday 11.00 - 01.30

Special conditions to include:
The provision of fume and odour abatement to the kitchen extraction system must be completed by the end of April 2007; no hot food is to be served after 11 pm until this work has been completed.
On Thursday, Friday and Saturday nights there must be at least two doormen on duty from 8 pm until the extended closing time.

The Applicant, Mr Cackett, presented his application to the Sub-Committee and explained that he was seeking to extend the hours of sale of alcohol during the evenings and to fill in hours during the afternoons when the club had not previously been open. He confirmed that the club was taking steps to reduce noise from the building and to attempt to encourage customers to consider the local neighbourhood when they left the club.

The Club Steward considered that the Club had been well run in the past and that noise in the neighbourhood could have come from other venues.

Mr Tinsley, an objector, showed the Sub-Committee the location of his property in relation to the Working Mens' Club. He explained that as there was no structure between the two properties, he could hear loud music from the club late at night, especially in the summer months. He confirmed that he had not made an official complaint. A member of the Sub-Committee explained that Mr Tinsley could contact Swale's Environmental Health Officer if there was a problem with noise in the future.

In order to reduce any noise coming from the building, Mr Cackett was advised that an alarm system could be fixed to the fire exit door, the windows kept closed and that air conditioning be considered in the future.

The Licensing Sub-Committee adjourned to make their decision at 3:00 pm. Members of the Sub-Committee, the Senior Solicitor and the Democratic Services Officer left the meeting and returned at 3:08 pm, when the Sub-Committee re-convened.

(1) That in respect of the application to vary the Premises Licence at Sheerness Working Mens' Club, 47 Queenborough Road, Halfway, Sheerness, the Sub-Committee's decision is attached as Appendix 1:
