MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Wednesday 6th October 2010 from 10:00 am to 10:21 am.

Present: Councillor George Bobbin (Chairman), Councillors Harrison and Lesley Ingham.

Officers Present: Kellie Mackenzie, Samantha Potts and Cath Wallen.

Also In Attendance: Councillor Mike Henderson, Stephen Barker and James Smith (Applicants) and Robert Jordan (Agent for applicant).

The Chairman opened the meeting by introducing the Sub-Committee and the Officers present. He then outlined the procedure that would be followed.

Councillor Mike Henderson (Ward Member) declared a prejudicial interest as he lived next-door to the premises. Councillor Henderson spoke on the item and then left the room.

application for a new premises licence under the licensing act 2003 - the corner shop, upper brents, faversham

Mr Jordan, the applicant's agent, presented the case on behalf of the applicant. He stated that the applicants had seven years experience in retail and currently operated a premises in Rochester. Mr Jordan advised that there were no other convenience stores within the locality so there was a need.

Mr Jordan drew attention to the letters of objection contained within the report. He stated that concerns about anti-social behaviour related more to public houses in the area. He considered the hours requested were reasonable and noted that the Police raised no objection. With regard to concerns about parking Mr Jordan advised that there were nine car parking spaces nearby. Mr Jordan added that the applicants would ensure litter was cleared from the site.

Councillor Mike Henderson, the Ward Member, asked Members to consider the concerns of local residents.

In response to queries, Mr Barker, the applicant, confirmed that they would be operating the Check 25 scheme rather than Challenge 21. He explained they operated the scheme at their store in Rochester where there were a high number of clubs and bars and it worked well.

The Sub-Committee adjourned to make their decision at 10:13 am. Members of the Sub-Committee, the Assistant Senior Solicitor and Democratic Services Officer left the meeting and returned at 10:18 am to make their decision.

RESOLVED:

(1) In respect of the New Premises Licence for The Corner Shop, Upper Brents, Faversham the Sub-Committee's decision is attached as Appendix 1:

Sale of alcohol (off the premises): Monday - Saturday 08:00-21:00
Sunday 10:00-21:00

Special conditions include:
(1) CCTV will be fitted and cover all areas of the premises including areas outside which belong to the premises. The system will display on recording the correct time and date of the recording.

(2) A system will be in place to maintain the quality of the recorded image and a complete audit trail maintained. The system will keep recorded images for a period of 28 days.

(3) The CCTV will be maintained so as to be fully operational during the hours the premises are open and a copy provided to the Police on request within 48 hours.

(4) Signage informing customers that CCTV is operational to be clearly displayed.

(5) All staff to be trained in their responsibilities under the Licensing Act 2003 to level 1 BII. This training must be auditable and available to Police, Local Authority Licensing Officer and Trading Standards on request.

(6) Challenge 21 scheme shall be adopted so that all staff are trained to ask any customer wishing to purchase alcohol, who appears to be under the age of 21 years, for evidence of age.

(7) Only ID acceptable will be passport, photo driving licence and any PASS marked identification.

(8) All staff to be fully trained in Challenge 21 and the training audited and available to Police, Local Authority Licensing Officer and Trading Standards Officers.

(9) Refusals book will be kept and made available to any Police Officer, Local Authority Officer or Trading Standards Officer at any reasonable time. The book will be bound and include the following details time of refusal, date of refusal, item refused, name or description of person refused, reason for refusal, name of member of staff refusing.
