MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Wednesday 2nd March 2011 from 10:25 am to 11:10 am.

Present: Councillor Alan Willicombe (Chairman), Councillors Lesley Ingham and Jean Willicombe (substitute for Councillor Adrian Crowther).

Officers Present: Geraldine Chidley, Angela Lynch, Kellie Mackenzie, Michael Moss, Samantha Potts and Donna Price.

Also In Attendance: Mr Quinlan (Licensee) and Mr Rowley (Police Licensing Officer).

The Chairman opened the meeting by introducing the Sub-Committee and the Officers present. He then outlined the procedure that would be followed.

application for a review of a street trading licence (non-festival)

The Chairman introduced the report which provided details of a breach of a street trading licence by Mr Quinlan. Mr Quinlan's current licence allowed him to sell hot and cold food from a trailer at the rear of the Forum Centre, Sittingbourne from Monday to Saturday between 06:00 am and 2.30pm.

Mr Moss, Enforcement Officer (SBC), presented the case on behalf of Swale Borough Council. He explained that on various occasions during September, October and November 2010 complaints had been received that Mr Quinlan was trading outside of his permitted hours and illegally operating from Berry Street, Sittingbourne. He stated that these incidents had been backed-up by evidence from Swale Borough Council's Principle Street Warden, Kent Police and CCTV.

Mr Moss stated that several warning letters and been sent to Mr Quinlan, who had admitted to the offences under caution. Mr Moss requested Members either revoke Mr Quinlan's licence, or consider a suspension and formal warning as a minimum penalty.

The Chairman then invited Mr Quinlan to put his case.

Mr Quinlan admitted trading outside of his permitted licence. He explained that he had been under extreme financial stress during the period in question, as due to an error by the Department of Works and Pension he had not been paid the 16 week rent and Council Tax rebate he had been entitled to. He considered he had no alternative therefore but to work extra hours.

The Sub-Committee adjourned to make their decision at 10:40 am. Members of the Sub-Committee, Assistant Solicitor and Democratic Services Officer left the meeting and returned at 10:57 am to make their decision.

RESOLVED:

(1) That Mr Quinlan's licence be revoked, following the 21 day appeal time.

The Chairman introduced the report which provided details of an application for a street trading licence to sell hot and cold food from a trailer on the A249 at Queenborough.

Mr Rowley raised objection to the application on the grounds of public safety. He stated that the site was located next to a busy road and the proposal would pose an unnecessary risk and distraction to the public. He added that there were already several purpose-built refreshment facilities not far from the site.

Members discussed the application and supported the concerns of Kent Police.

RESOLVED:

(1) That an application for a Street Trading Licence to sell hot and cold food from a trailer on the A249 Queenborough, be refused on grounds of highway safety.
